Terms of Service
These terms apply to the Whyp mobile app and the website whyp.app (together, “Whyp”). By installing or using Whyp you agree to them. If you do not agree, please do not use Whyp.
1. Who we are
Whyp is provided by:
FLOWVATE DEVELOPMENT LTD
Galateias 2-4, 8046 Paphos, Cyprus
Registration number: HE 457494
E-mail: [email protected]
In these terms “we”, “us” and “our” mean FLOWVATE DEVELOPMENT LTD; “you” means the person using Whyp.
2. What Whyp does
Whyp shows fuel prices on a map, suggests fuel stops along your route, offers turn-by-turn navigation, records your trips and their cost, and lets you compare drives with friends. Some features need an account, your location or a paid subscription. Features and the areas they cover may change over time.
3. Who can use Whyp
You must be at least 16 years old and able to enter into a binding agreement under the law of the country where you live. You are responsible for keeping your device and your account secure.
4. Drive safely and obey the law
- Keep your eyes on the road. Set up routes and settings before you drive or when you are safely parked. Do not handle your phone while driving where the law forbids it.
- Traffic rules, road signs and the instructions of the police always come before anything Whyp shows you.
- Alerts about speed cameras and road incidents are restricted or forbidden in some countries. It is your responsibility to know the rules where you drive and to switch these alerts off where they are not allowed.
- Leaderboards and trip scores are not an invitation to speed or take risks. Never use Whyp to race on public roads.
5. Information in the app
Fuel prices, station details, maps, routes, traffic, camera locations and trip figures come from public data, third-party providers and your phone’s sensors. They can be incomplete, delayed or wrong. Prices at the pump are the ones that count. Fuel consumption, costs and savings in Whyp are estimates. Do not rely on Whyp as your only source of information for decisions that matter.
Map data © OpenStreetMap contributors and other providers named in the app. Fuel price data is used under the licences of the public bodies that publish it.
6. Your account and your content
You can start using Whyp without an account. Some features (for example sync, friends and Whyp Pro) need you to sign in with Apple. You keep the rights to what you add to Whyp, such as trips, photos of receipts, names of routes and messages. You give us a licence to store, process and show this content only as needed to run Whyp for you and for the people you choose to share it with.
You must not use Whyp to harass others, share someone’s location without their consent, post unlawful content, break or overload our systems, copy our data in bulk or reverse engineer the app, except where the law allows it.
7. Friends and shared drives
When you join a shared drive or turn on live location, the friends in that drive can see your position, speed and route while it is active. You can leave a shared drive or turn off live location at any time. Only share with people you trust.
8. Whyp Pro and payments
- Whyp is free to download. Whyp Pro is an optional subscription that unlocks extra features. Prices are shown in the app before you buy.
- Subscriptions are sold and billed by Apple through your Apple Account and renew automatically for the same period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple Account settings.
- If a free trial is offered, it turns into a paid subscription at the end of the trial unless you cancel before it ends.
- Refunds are handled by Apple under its rules. This does not limit any rights you have as a consumer under the law of your country.
- Promotions such as free months for inviting friends may have their own conditions, shown when the promotion is offered.
9. Our rights in Whyp
Whyp, its design, its name and logo, and its software belong to us or our licensors. We give you a personal, non-exclusive, non-transferable right to use the app on Apple devices you own or control, in line with these terms and Apple’s Usage Rules.
10. Apple
These terms are between you and us, not Apple. Apple is not responsible for Whyp or its content and has no obligation to provide maintenance or support for it. If the app fails to meet any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the app. Apple is not responsible for any claims relating to the app, including product liability, legal or regulatory claims, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties.
11. Changes and ending the service
We may update Whyp and add, change or remove features. We may change these terms; if a change is important we will tell you in the app or by e-mail before it applies. You can stop using Whyp and delete your account at any time in the app. We may suspend or close an account that seriously or repeatedly breaks these terms.
12. Liability
We provide Whyp with reasonable care and skill, but we cannot promise that it will always be available, error-free or suitable for every purpose. To the extent the law allows, we are not liable for indirect or unforeseeable loss, for loss caused by information from third-party sources, or for fines, accidents or damage arising from the way you drive. Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or any other liability that cannot be limited by law, and nothing affects your statutory rights as a consumer.
13. Law and disputes
These terms are governed by the law of the Republic of Cyprus. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you may bring a claim in the courts of that country. Before going to court, please write to us at [email protected] so we can try to solve the problem.
